On October 9, 2025, the West Seneca Planning Board considered the application to rezone and special permit for 1245 Seneca Creek Road from R90 to R60(S) for construction of a Banquet facility and on-site hotels (up to 60 guest rooms).
There are a number of issues with this request that needs to be resolved.
First, this is a rezone of more than 10 acres for non-residential purposes and therefore is a Type 1 action under SEQRA. This requires a Full Environmental Assessment Form but a Short Environmental Assessment Form was submitted.
Second, this appears to be spot zoning. Rezoning a specific parcel of land for a use different from its neighbors is considered spot zoning when it is not consistent with the community’s comprehensive plan and is seen as arbitrary or unreasonable. These types of changes are typically viewed with caution because they can negatively impact the public interest and the character of the neighborhood.
1245 Seneca Creek Rd is in the middle of a group of properties zoned R90 that a predominantly 1 or 2 family homes.
According to the 2016 Comprehensive Plan this property is designated as being Recreation & Open Space.
Construction of on-site hotels and expansion of the parking lot is inconsistent with the Comprehensive Plan, will negatively impact the public interest and the character of the neighborhood.
